Carrier Disclaimer

Wireless carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier, device, network, and other factors beyond our control.

Mobile Information

We do not sell or share mobile phone numbers, SMS opt-in data, or SMS consent information with third parties for their own marketing purposes.

Mobile information may be provided to vendors, telecommunications providers, and other service providers when necessary to operate, support, secure, or deliver Trust Teddy's messaging services. SMS consent cannot be transferred to another business for that business's independent marketing purposes.

Products or services may be offered by third parties. The merchant of record is responsible for their products, pricing, fulfillment, returns, and other obligations.

Products or services made available in connection with Trust Teddy may be offered, sold, processed, shipped, or fulfilled by third parties.

Where another business is the seller or merchant of record, that business remains responsible for its products, pricing, inventory, fulfillment, shipping, returns, refunds, warranties, and other merchant obligations unless expressly stated otherwise.

Trust Teddy does not guarantee the availability, quality, condition, delivery date, or suitability of products or services supplied by independent third parties.

10. Intellectual Property

Trust Teddy and its associated technology, branding, and content are owned by or licensed to Teddy Tech Inc.

Trust Teddy and its associated technology, branding, trademarks, logos, graphics, software, designs, content, interfaces, documentation, processes, and other intellectual property are owned by or licensed to Teddy Tech Inc., except where otherwise stated.

Trust Teddy branding and related names, logos, and designs may not be copied, reproduced, modified, distributed, or used without authorization.

Nothing in these Terms grants users ownership of or rights to Trust Teddy's underlying technology, systems, methods, intellectual property, or proprietary information.

11. Prohibited Uses

You may not use Trust Teddy to commit fraud, harass others, violate privacy, distribute malicious software, or violate applicable laws.

You may not use Trust Teddy to:

  • Commit or facilitate fraud;
  • Harass, threaten, deceive, or impersonate another person;
  • Violate another person's privacy;
  • Submit information you are not authorized to provide;
  • Distribute malicious software or harmful code;
  • Circumvent security protections;
  • Attempt unauthorized access to Trust Teddy systems;
  • Reverse engineer Trust Teddy technology except where such restriction is prohibited by law;
  • Scrape or automatically extract Trust Teddy information without authorization;
  • Interfere with Trust Teddy's operation; or
  • Violate applicable laws or regulations.

Trust Teddy may restrict or terminate access where it reasonably believes the service is being misused.

12. Security

Trust Teddy uses reasonable safeguards to protect information, but no internet-based service can be guaranteed completely secure.

Trust Teddy uses reasonable administrative, technical, and organizational safeguards designed to protect information and its services.

However, no internet-based service, electronic communication, or information-storage system can be guaranteed to be completely secure.

Users are responsible for taking reasonable precautions when accessing online services and protecting their own devices, accounts, and credentials.

13. Service Availability

Trust Teddy may modify, update, suspend, or discontinue portions of its services at any time.

Teddy Tech Inc. will not be liable for indirect, incidental, or consequential damages arising from the use of Trust Teddy.

To the maximum extent permitted by applicable law, Teddy Tech Inc., Trust Teddy, and their respective officers, directors, employees, and agents will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to the use of, inability to use, or reliance upon Trust Teddy services.

Trust Teddy is not responsible for losses caused solely by independent third parties, wireless carriers, merchants, payment providers, shipping providers, telecommunications providers, internet outages, or other circumstances outside Trust Teddy's reasonable control.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

16. Indemnification

You agree to indemnify and hold harmless Teddy Tech Inc. from claims arising from your misuse of Trust Teddy or violation of these Terms.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Teddy Tech Inc., Trust Teddy, and their respective officers, directors, employees, and agents from claims, damages, liabilities, and reasonable expenses arising from your unlawful misuse of Trust Teddy, your violation of these Terms, or your infringement of another person's rights.

17. Suspension & Termination

Trust Teddy may suspend or terminate access to its services when reasonably necessary. You may stop using Trust Teddy at any time.

Trust Teddy may suspend or terminate access to its services when reasonably necessary because of:

  • Violation of these Terms;
  • Suspected fraudulent or unlawful activity;
  • Security concerns;
  • Abuse or misuse of the service;
  • Legal or regulatory requirements; or
  • Conduct that may harm Trust Teddy, its users, service providers, or third parties.

You may stop using Trust Teddy at any time.

SMS participation may be separately discontinued at any time by replying STOP.

These Terms & Conditions and any dispute arising out of or relating to these Terms or the use of Trust Teddy will be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict-of-law principles, except where applicable federal law or consumer-protection law requires otherwise.

Nothing in these Terms limits any rights or protections that cannot lawfully be waived under applicable law.

20. Severability

If any provision of these Terms is invalid or unenforceable, the remaining provisions will remain in effect.

21. Entire Agreement

SMS consent is specific to the person providing it. Providing another person’s mobile number does not, by itself, constitute that person’s consent to receive recurring automated SMS messages from Trust Teddy.

After submitting an opt-out request, you may receive one final text message confirming that your request has been processed.
Once the opt-out has been processed, Trust Teddy will discontinue further SMS messages covered by that consent unless you subsequently provide consent again.
